Resumo: O objetivo do presente trabalho é determinar epistemologicamente a natureza do Direito Canônico, se é saber jurídico ou teológico. Essa definição é imprescindível para a comunidade científica brasileira, considerando que Juristas seculares ignoram estudos e pesquisas realizados por Canonistas, enquanto o Direito Canônico é matéria de interesse e estudo de Teólogos que não consideram a sua heteronomia e coercibilidade: ambos elementos fundamentais para a caracterização do que a comunidade jurídico-científica considera Direito. Essa disparidade no conhecimento do Direito Canônico pode afetar diretamente a pesquisa do seu objeto por utilização de metodologia não adequada, assim como a sua eficácia como ciência aplicada ou não. Esse dilema, por sua vez, embaraça o reconhecimento oficial da disciplina como científica e passível de atribuir a seus estudiosos grau acadêmico no Brasil.

Abstract: The objective of the present paper is to determine epistemologically the nature of Canon Law, whether it is a juridical or a theological knowledge. This definition is essential to the Brazilian scientific community, considering that secular jurists ignore the study and the research carried out by Canonists, whereas Canon Law is a matter of interest and study by theologians who do not consider it heteronomy and forcibility: both fundamental elements for the characterization of what is considered Law by the legal-scientific community. This disparity in the knowledge of Canon Law can directly affect the research of its object, by using an inadequate methodology, as well as its effectiveness as applied science or not. This dilemma hinders the official recognition of the discipline as scientific and as apt to attribute to its researchers an academic degree in Brazil.
